1. Privacy Statement

Thanks for using the MixRadio App (“Service”) which is provided by MixRadio Limited (“MixRadio, “we”, “our”, “us”), located at 11-19 Wine Street, Bristol, United Kingdom.

MixRadio is committed to respect your privacy and comply with applicable data protection and privacy laws.

If you do not agree with this Policy, do not use MixRadio or provide us with your personal data.

2. What the Privacy Policy Covers

Our Privacy Policy explains:

  • What data and information we collect and why we collect it
  • How we use that information
  • Information about how to access and update your information
  • Information we share with 3rd parties
  • Steps we take to keep your information safe

2.1 Who Is the Controller of Your Data?

Your personal data (“Personal Information”) is controlled by MixRadio.

3. Your Consent

The MixRadio services include the following collection, processing, use and transfer of your Personal Information that requires your consent:

  • The collection, use and transfer of your postal code (as far as it is collected, see Sec. 4.1) as well as the use and transfer of your Personal Information as described in Sec. 4.1 4.4, 4.5 and 4.7 for the purpose of providing you with tailored advertising (see Sec. 5.4 and 7.2) and for improving the Service (see Sec. 5.3 and 5.5).
  • The use of the information about your name and language from the operator of the federated account (see Sec. 4.2).
  • The use of your Personal Information to send you information about new features, music and offers from MixRadio (see Sec. 5.2).
  • In such instances where you have made a payment to us, the Personal Information provided pursuant to Sec. 4.3.
  • The use of your device ID (IMEI and IMSI) for the purpose of creating an anonymous account for you (see Sec. 4.5).
  • The provision of information to certain third parties in accordance with Sec. 6.1, 5.1, 7.2 and 7.4.
  • The collection, processing and transfer of your data as otherwise specified within this policy.

You will be asked to declare your consent within the MixRadio service. You may withdraw your consent at any time.

We shall use the Personal Information that we receive from you in full accordance with the applicable law in your country.

4. What Information and Data We Collect

This chapter explains what Personal Information and other data and information we collect and how we collect them.

We collect Personal Information through the Service, especially through the MixRadio account that you may create (“MixRadio account”) (see Sec. 4.1). Where you are not required to create a MixRadio account, we collect the information through an anonymous account that we create for you (see Sec. 4.5).

4.1 Personal Information You Give Us

When you create a MixRadio account, we will ask you for Personal Information, like your name, email address, date of birth and postal code. Your email address is the username for your MixRadio account. We will use your email address and name for communicating with you (see Sec. 5.2). We use Personal Information to provide you with tailored services (see Sec. 5.1), to improve the Service (see Sec. 5.3 and 5.5) and to provide you with tailored advertising (see Sec. 5.4). We use your date of birth to verify that you are old enough to use the service in your country (see Sec. 5.8). You can also provide us with your gender via the MixRadio account which we use together with your date of birth to provide you with even better targeted services (see Sec. 5.1) and tailored advertising (see Sec. 5.4).

When you create a MixRadio account you will be asked to specify a password for it. Also, your email address and password will be used to confirm your right to access premium services (see Sec. 5.7).

The Personal Information is stored in accordance with local laws, using strong encryption (or one-way hashing where appropriate). You may also access the Service or use certain aspects of the Service using your Social Network, such as Facebook or Google+, log-in credentials (please see Sec. 4.2).

You may also give us Personal Information when you contact us (your email address and phone number) which we only collect for contacting you in accordance with Sec. 5.6.

4.2 Personal Information from Federated Accounts

If you access the Service using another account’s credentials, such as your Facebook or Google+ details, we ask you to authorise us to collect your public profile which may include your name and preferred language. We will also receive a Unique ID created by the operator of the federated account which we use to identify you for providing you with tailored services (see Sec. 5.1).

If you log in with a federated account, you will be asked whether you would like to share your email address with MixRadio.

You understand and agree that Facebook’s or Google’s and other third parties’ use of information they collect from you is governed by their privacy policies, and MixRadio’s use of such information is governed by this Privacy Policy.

4.3 Payment Details

If we offer and you choose to subscribe to fee-based parts of our Service or purchase add-on products or services, you must create a MixRadio account (see Sec. 4.1) and you will be asked to choose a payment method, such as operator billing, credit card or PayPal. Your credit card information and other financial data that we need to process your payment are collected and stored by third party payment processors. We may collect some limited information, such as your postal code, mobile number and details of your transaction history. In each case, the information that is collected pursuant to this Sec. 4.3 shall only be that which is required in order to complete a payment process in connection with the provision of the Service to you.

4.4 Listening Activity

When you use our Service, we collect the following information about your listening activity through your MixRadio account: how you interact with the Service, which may include the number and title of songs you have listened to, the songs and artists that you like and dislike, mix selections, your interaction with the app, the stations you create or listen to, the number of songs you skip, how long you listen to a mix and how you navigate through the services for (i) the purpose of offering you tailored content by building a taste profile for you (see Sec. 5.1), (ii) the improvement of the MixRadio service (see Sec. 5.3 and Sec. 5.5) and (iii) providing tailored advertising (see Sec. 5.4).

If you haven’t created an account, we will collect the aforementioned information through an anonymized account (see Sec. 4.). The anonymous account is necessary to provide you with tailored content (Sec. 5.1).

4.5 Technical Data

We collect the following technical data: device model, device manufacturer, IP address, the Mix ID (an identifier for what playlist you are listening), Unique device ID (hashed IMEI; hashed IMSI, Mobile Network Code and Mobile Country Code), Browser User Agent, network and device performance, language, operating system (“OS”), the date and time you visited the Service for the provision of tailored content (see Sec. 5.1), the improvement of the Service (see Sec.54.3 and 5.5) and the provision of tailored advertising (see Sec. 5.4).

We use your device ID to create an anonymous account for you in case you do not create a MixRadio account. The anonymous account is used by us as described in Sec. 4.4.

4.6 Financial Transactions

We collect data on both online and offline music consumption, including tracking what users listen to, for billing purposes, such as for paying royalties and license fees to third party providers, who include record labels and other copyright holders and content distributors. Please see also Sec. 7.1.

This information is processed in a de-identified manner to provide aggregate licensing reports back to the rights holders of the music content.

4.7 Location Data

To provide you with the best possible tailored service (see Sec. 5.1), to improve our services (see Sec. 5.3 and 5.5) and provide you with tailored advertising (see Sec. 5.4), we would like to collect your instantaneous location information (latitude/longitude limited to town level accuracy).

5. How We Use Personal Information and Other Data

5.1 Offer Tailored Content

We use the information we collect to personalise your experience with MixRadio. This is done based on music you have listened to and the artists and tracks you tell us that you like (see Sec. 4.4), the Personal Information you have provided us with (see Sec. 4.1), collected technical data (see Sec. 4.5) and collected location data (see Sec. 4.7). By using this information, we will be building a taste profile for you, which we will use to provide you better music when you use our Service.

We would also like to offer you more relevant advertising. To do so, we transfer the information to a third party providers; for a more detailed description please see Sec. 7.2 and 7.3.

5.2 Send You Messages

When you create a MixRadio account or contact us, or when we received your contact details (your email address and phone number) from the previous owner of MixRadio, Microsoft, when MixRadio was sold to LINE Corporation, we use your contact details to send you information about new features, music and offers from MixRadio. You may opt out of receiving these emails at any time by adjusting the preferences in your MixRadio account (see Sec.6.2) or by following the link provided in each of the communications in which we provide you with information about features, music and offers in connection with the Service.

5.3 Improve Your User Experience

We may use Personal Information that you provide (see Sec. 4.1), including your interaction with the Service that are made available to otherwise improve your user experience (see Sec. 4.4 and 4.7) and the collected technical data (see Sec. 4.5). We will also use this Personal Information to ensure the correct technical functioning of the Service, help us quickly and efficiently respond to inquiries and requests, and otherwise enhance our Service offering for our users.

5.4 Showing Relevant/Tailored Ads

We may use your Personal Information that we have collected (see Sec. 4.1, 4.4, 4.5 and 4.7) to customise and personalise the advertising content that is delivered to you. To do so, we transfer the Personal Information to our third party advertising providers; for a more detailed description please see Sec. 7.2 and 7.3.

5.5 Service Improvement

We continuously strive to improve MixRadio. On the basis of the technical data collected (see Sec. 4.5) and the information about your interaction with the Service we generate and compile anonymous, aggregated statistics that allow us to understand how users navigate and use our Service. The aim is to maintain, protect and improve MixRadio, to develop new features and to protect MixRadio and all our users.

5.6 When You Contact Us

We provide customer service through our support pages located in mixradiomusic.com/help and email help@mixrad.io. In order to provide you with support, we may ask for your email address and other account information that is necessary to provide you with the customer service when you contact us. You may also contact us via email help@mixrad.io if you have any questions related to our Privacy Policy and your personal information (see Sec. 10). We may keep a record of your communication to help resolve any related issues you might be facing.

5.7 Confirm Right to Access Premium Services

We use your MixRadio account details (see Sec. 4.1) to verify your access rights to premium content or other access-restricted services and software and to prevent any misuse of our Services. When you log into the Service, we will keep you logged in to ensure you get the features you are entitled to. You can log out under the Settings menu if you want to.

5.8 Children

The Service is not directed to children under the age of 13 (“minors”), and we do not knowingly collect personal information from children under the country-specific minimum age. If you are under the age specified in your country, do not use the Service and do not provide any personal information to us. If we discover that a child under thirteen (13) years old has provided us with personal information, we will immediately delete it.

We use your date of birth that you provide us (see Sec. 4.1) to verify that you are not a minor respectively under 13 years old.

6. Your Access to Information

You may manage your Personal Information through your MixRadio account.

6.1 Accessing and Updating Your Personal Information

We will provide you with access to update your account information. When updating your personal information, we may ask you to verify your identity before we can act on your request.

You are responsible for maintaining the secrecy of your password and account information at all times.

6.2 Manage Your Personal Information and Preferences

When you have created a MixRadio account, you can access it from the settings part on the Service to view and edit your account information and preferences. Sign in to your MixRadio account and modify your Personal Information and preferences as needed. Please note that you cannot opt out of messages that are necessary for the provision of the service.

6.3 Handling Requests for Personal Information

At your request and where the law requires us to do so, we will confirm what Personal Information we store about you (see Sec. 10). We will respond within a reasonable period of time upon verification of your identity.

6.4 Retaining Your Personal Information

We will retain your Personal Information for as long as it is required for the purpose it was collected or as needed to provide you services. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

7. Personal Information We Share

We do not rent or sell any of your Personal Information, but we share your Personal Information with third parties in cases described as follows and only to the extent permitted by law.

7.1 For External Processing (e.g. Label Reporting and Financial Transactions)

We collect information on online music consumption for billing purposes, such as paying royalties and license fees to third party providers, who include record labels and other copyright holders and content distributors (see Sec. 4.6). This Personal Information is processed and shared in an anonymized manner to provide aggregate licensing reports back to the rights holders of the music content.

7.2 Targeted Advertising

We need advertising revenue to operate a sustainable business. By targeting adverts you are more likely to receive ads that will be of interest to you.

The targeted ads that you receive are provided by third party advertising providers that we work together with. We provide the advertising provider with your Personal Information (see Sec. 5.4) which the advertising provider uses to customize the advertising. For this purpose, the Service uses a platform advertising ID. The advertising ID is a non-permanent unique device identifier, which is generated by the OS (or if unavailable from the OS then by the service) each time the application is started. We share the advertising ID with the advertising provider. The advertising ID enables the advertising provider to re-use data and information from other device Apps if the operator of the other device App is a contractual partner of the advertising provider as we are. Re-use of data means that if you have used a different app and that app had used the same advertising provider, then the advertising provider can use your information from the other app to facilitate the provision of targeting advertising to you.

The advertising ID also gives you more control over the advertising providers’ ability to serve you with targeted ads and helps us increase the relevancy of ads we provide to you.

7.3 Customised and Localised Advertising

We may use the Personal Information we collect to provide, personalise, and improve your experience with the Service and products made available through the Service by providing customised or localised advertising (see Sec. 5.1). The advertising provider that we work together with (see Sec. 7.2) customizes and tailors adverts using your Personal Information as described in Sec. 5.1. To do so, we provide the advertising provider with your Personal Information from your MixRadio account (see Sec. 4.1), your Personal Information about your listening activity (see Sec. 4.4), technical data (see Sec. 4.5) and your location data (see Sec. 4.7). However, your device ID, including IMSI and IMEI, is only provided in an encrypted one-way hashed format to advertising providers.

7.4 With Service Providers

We may use third parties to manage portions of the Service, facilitate our business (e.g. by hosting our servers or providing payment processing services to us), manage communications with you, or otherwise provide services to us in connection with our Service (“Service Providers”). Where these Service Providers process information on our behalf, we require these third parties to comply with the provisions of this Privacy Policy, to the extent applicable, and require that they comply with applicable data protection and privacy laws and maintain reasonable security measures and do not use your Personal Information for any purpose other than to provide their services to us.

7.5 Compliance with Regulatory Authorities

We will share Personal Information with companies, organisations or individuals outside if that access, use, preservation or disclosure of the information is necessary to meet any applicable law, regulation, legal process or enforceable governmental request.

7.6 For Legal Reasons, Including Copyright

We may also share your Personal Information to third parties to respond to legal process (e.g. a court order), if we believe in good faith that it is necessary to do so; to comply with requirements of mandatory applicable law; to protect the rights and property of MixRadio, including to enforce the Service Terms; and to address fraud, security or technical issues.

7.7 To Protect a Person

We may also share Personal Information with companies, organisations or individuals outside MixRadio if we have a belief in good faith that access, use, preservation or disclosure of the information is reasonably necessary to protect against harm to the rights, property or safety of MixRadio, our users or the public, as required or permitted by law.

7.8 Asset Transfer Related to Merger or Acquisition

We may share your Personal Information with third parties to the extent necessary to allow us a merger, acquisition, or sale of all or a portion of our assets. By proceeding to use MixRadio’s Service, you agree to us sharing this personal data for such purpose.

8. Information Security

8.1 Verification of Account (Password Validation)

We are committed to protecting your Personal Information. Your password protects your MixRadio account once created, so you should use a unique and strong password, limit access to your mobile device, and sign off after having used the Service. You are responsible for maintaining the secrecy of your password and account information at all times.

While we take reasonable data protection precautions, no security measures are completely secure, and we do not guarantee the security of Personal Information at any time.

Privacy and security are key considerations in the creation and delivery of our products and services. We have assigned specific responsibilities to address privacy and security related matters. We enforce our internal policies and guidelines through an appropriate selection of activities, including proactive and reactive risk management, security and privacy engineering, training and assessments. We take appropriate steps to address online security, physical security, risk of data loss and other such risks taking into consideration the risk represented by the processing and the nature of the data being protected. Also, we limit access to our data bases containing personal data to authorised persons having a justified need to access such information.

11. Cookies (Only for MixRadio’s Website Privacy Policy)

Cookies are small bits of electronic information that a website/App sends to a visitor's browser and are stored on the visitor's hard drive. Cookies may be either "persistent" cookies or "session" cookies: a persistent cookie will be stored by a browser and will remain valid until its set expiry date, unless deleted by the user before the expiry date; a session cookie, on the other hand, will expire at the end of the user session, when the web browser is closed. Cookies that are placed by us are called “First-Party-Cookies”. Cookies that are not placed by a third party are called “Third-Party-Cookies”.

11.1 Cookies We Use (First-Party-Cookies)

We both session and persistent cookies on our website/in our App to collect the information and data described in Sec. 4. In addition, Third-Party-Cookies (both session and persistent cookies) are placed on your terminal equipment (e.g. computer or mobile device) when you visit our website or use the App. The cookies automatically expire after 1 year. We do not use Flash-Cookies.

We use cookies for the following purposes: (i) providing you with tailored content (see Sec. 5.1), (ii) the improvement of our services (see Sec. 5.3 and 5.5), (iii) generating the advertising ID (see Sec. 7.2), (iv) creating the anonymous account in case you do not create a MixRadio account (see Sec. 4.5), (v) identify that your web browser have accessed the service and that you have logged in, (vi) to monitor irregular account behaviour and implement fraud protection rules.

11.2 Third-Party-Cookies

Third-Party-Cookies are used on our website/in our App as follows:

(Audio) Adswizz Inc. of 385 1st Avenue, San Mateo, CA and (Display) Pubmatic, Inc. of 305 Main Street, 1st floor, Redwood City, CA 94063, the advertising provider that we work with, places cookies on your terminal equipment (e.g. computer or mobile device) when you visit our website or use the App enabling us to provide tailored advertising (see Sec. 5.4 and 7.2). Through the cookies, the advertising provider collects your technical data as described in Sec. 4.5.

We also use Google Analytics, provided by Google Inc. (“Google”), on our website/in our App to analyse the use of our website. Our analytics service provider generates statistical and other information about website/App use by means of cookies. The information generated relating to our website/App is used to create reports out the use of our website/App. Our analytics service provider's privacy policy is available at: google.com/policies/privacy. We do not share the data provided by Google with other parties.

11.3 Your Consent for Placing Our Cookies and Third-Party-Cookies

As for the cookies placed on your computer: Most browsers allow you to refuse to accept cookies; for example: In Internet Explorer (version 10) you can block cookies using the cookie handling override settings available by clicking "Tools", "Internet Options", "Privacy" and then "Advanced"; in Firefox (version 24) you can block all cookies by clicking "Tools", "Options", "Privacy", selecting "Use custom settings for history" from the drop-down menu, and unticking "Accept cookies from sites"; and in Chrome (version 29), you can block all cookies by accessing the "Customise and control" menu, and clicking "Settings", "Show advanced settings" and "Content settings", and then selecting "Block sites from setting any data" under the "Cookies" heading.

Regarding cookies placed on your mobile device when you visit our website using a browser such as Internet Explorer, Firefox or Chrome, you may block cookies using the tools provided by these browsers. When you install the MixRadio app on your mobile device, you will be asked about your consent for the collection and transfer of certain information from your mobile device.

Blocking cookies might have a negative impact on the usability of many websites. If you block cookies, you may not be able to use all the features of our services.

11.4 Deletion of Our Cookies and Third-Party-Cookies

You can delete cookies already stored on your computer/device; for example: in Internet Explorer (version 10), you must manually delete cookie files (you can find instructions for doing so at support.microsoft.com/kb/278835); in Firefox (version 24), you can delete cookies by clicking "Tools", "Options" and "Privacy", then selecting "Use custom settings for history", clicking "Show Cookies", and then clicking "Remove All Cookies"; and in Chrome (version 29), you can delete all cookies by accessing the "Customise and control" menu, and clicking "Settings", "Show advanced settings" and "Clear browsing data", and then selecting "Delete cookies and other site and plug-in data" before clicking "Clear browsing data".

Deleting cookies will have a negative impact on the usability of our services.
